Terms & Conditions

The role of African Bush Bird Tours CC/2004/2355 (ABBT CC/2004/2355) is to put together tours and itineraries to fit the requirements of our customers. In doing so, we may use independent suppliers for the provision of selected services. However we accept responsibility for the proper performance of your contract with us subject to the following booking conditions.

Included: (this may vary from itinerary to itinerary)
The services that are included in a tour package are subject to the specific itinerary and will be written below each itinerary. This will include the meal basis, entrance fees, overnight accommodation, activities and sightseeing’s etc. Guided tours will be conducted in a Toyota Quantum, Toyota Fortuna or similar vehicle which is most suitable for the conditions of the country. Maximum and minimum participants for a guided tour should be requested for each itinerary individually. lodge- and hotel tours are accommodated as set out in each itinerary and are subject to availability at time of booking. If a booking is for only half of a double room ABBT CC/2004/2355 will try to find a suitable person to share the double room with the guest. Should this not be possible the booking will be changed to a single room and the single supplement must be charged to the client who should occupy the room.

Not Included: (this varies from itinerary to itinerary)
Insurances to cover for cancellation and curtailment, medical, baggage and money, emergency evacuation back home; gratitude’s for porters, hotel staff and guides; any excursion not related to the booking and tour package; optional meals; scheduled airfares; transfers and departure fares as well as entrance fees in certain Southern African States, laundry services, beverages and telephone calls.

Passport & Visas
The onus is upon the guest to ensure that passports and visas are valid for the countries visited. The company, their staff and their agents cannot be held responsible for any visas, etc. not held by the guests, nor the costs of visas.

Responsibility
Neither ABBT CC/2004/2355 (the Company) nor any person or agent acting for, through or on behalf of the company shall be liable for any loss or damage whatsoever arising from any cause whatsoever and without restricting the generality of the a foregoing shall particularly not be responsible for the loss or damage arising from any errors or omissions contained in its brochure or any other literature, loss or damage caused by delays, sickness, theft, injury or death. The Company shall further have the right to at any time at its discretion cancel any safari or tour or the reminder thereof or make any alterations in route,  accommodation, price or other details. The Company may alter its safaris / tours if it’s been rendered impossible, illegal, or inadvisable by weather, strike, war, government or interference or any other cause whatsoever, the extra expenses incurred as a result thereof shall be the responsibility of the passenger. ABBT CC/2004/2355 may at its discretion and without liability or costs to itself at any time cancel or terminate the guest’s booking and in particular without limiting the generality of the a foregoing it shall be entitled to do so in the event of the illness or the illegal, improper or incompatible behaviour of the guest, who shall in such circumstances not be entitled to any refund. The person making the booking shall by his/her signature thereof assume personal liability for the total price of all bookings made by him/her. He/she should have the authority to enter into a contract on behalf of the other person/persons and in the event of non-payment be fully liable for the total costs incurred by his/her doing.

Liability
Each package requires the organization of transport, meals, entrance fees, accommodation and/or other facilities or services. ABBT CC/2004/2355 has no direct day to day control over its suppliers. Accordingly ABBT CC/2004/2355 accepts no responsibility for any injury, damage, loss, accident, delay, irregularity and/or inconvenience which may be occasioned by any defect in any object (including vehicle) utilised by any supplier for the supply of any service or by an act or omission of any supplier or its servants or agents. ABBT CC/2004/2355 shall not be liable for any loss or expense arising from the loss of property, cancellation or curtailment of the tour however caused, save only to the extent that such a loss of baggage, cancellation or curtailment was caused by the gross negligence of ABBT CC/2004/2355. If sickness or accident interrupts a tour, ABBT CC/2004/2355 shall not be liable for any costs or expense arising there from, save only to the extent that such sickness or accident was caused by ABBT CC/2004/2355's wilful act or gross negligence. ABBT CC/2004/2355 shall not be liable for any refund, either total or partial, of passage money paid. ABBT CC/2004/2355 recommends that the client advice passengers to take out necessary insurance to protect the passengers against such eventuality. We need to receive any claim in writing within 28 days after the end of our services under the contract. Where any payment is made, you will assign to ABBT CC/2004/2355 or our insurers any right you may have to pursue any third party in relation to the claim and provide us with your full co-operation. Carriers etc.: In respect of air, sea and rail carriers, land vehicles and hotel owners our liability is in all cases limited as if we were carriers/hoteliers within the appropriate international conventions. Furthermore, all transport is provided subject to the relevant carriers conditions of carriage, some of which may limit or exclude their liability to you, often in accordance with international conventions.
General - Please note our responsibilities and obligations apply only in respect of those services, which we agree to arrange or provide on your behalf. We cannot accept any liability for any services which you arrange on your own.

Under no circumstance can ABBT CC/2004/2355 be held liable for any cost arriving from, before, during or after your travel, that can be related to or can be put into conjunction with any pandemic illness. Also ABBT CC/2004/2355 cannot be held liable, if you should pick up an pandemic related illness during your travel.

Prices
All prices are based on costs at the time of publication. We reserve the right to change the prices at any time before your booking is made. We will confirm price changes, if any, together with our confirmation of your booking. Please notice that the prices are in Namibian Dollars (N$). ABBT CC/2004/2355 reserves the right to change prices at any given time, if prices of Service providers have changed as well as fluctuations in foreign currencies.

Payments
A deposit of 20% must be paid latest 10 days after our confirmation of booking. The remaining amount must be paid latest 45 days before commencement of our services. In some cases like the luxury trains and some safaris we need the payment 60 days before commencement of our services. If payments have not been received in time, we reserve the right to cancel your booking. All costs connected to a money transfer, is to the clients account.

Cancellation
More than 45 days before arrival: 20 % of total costs
45 - 31 days before arrival: 30% of total costs
30 - 15 days before arrival: 70% of total costs
14 - 0 days before arrival: 100% of total costs
The client can at any given stage cancel his/her participation of any given tour or booking in writing - the relevant cancelation fee will then apply accordingly. In the unlikely event that we have to cancel a tour for any reason we will try and offer the choice of an alternative arrangement or you will receive a full refund. We will do our utmost to inform you about any cancellations earliest possible.

Baggage
The baggage is limited to a maximum weight of 20kg per person. In cases of fly-in safari the baggage is limited to 10kg soft bag per person. In cases of a camping safari no hard case suitcases are allowed only soft bags.

Changes
ABBT CC/2004/2355 reserves the right to make changes to brochure details and arrangements both before and after the booking has been made. Most changes will be minor, but if we have to do significant changes you will be notified at the earliest possible opportunity. In such cases if tour bookings change with 10% or more of the total costs you will have the opportunity to accept the changes or to receive a refund excluding the non-refundable deposit paid before.

Jurisdiction
This agreement is made subject to and shall be governed by and construed according to the laws of Namibia.

To the best of our knowledge the brochure and Terms & Conditions are correct at the time of printing. We cannot be held responsible for any inaccuracy or changes that may occur after printing.
